DECEMBER 22, 2023 - from William T. Newton
Maryland Secretary of State Susan Lee needs to "slow her roll".
Maryland IS NOT like some other states in that Maryland's Secretary of State is appointed NOT elected and does NOT have any authority over the execution of elections beyond the paper shuffling.
Essentially the SOS is merely an actual "secretary"...... The source:
With regard to elections, the Secretary of State receives petitions to bring Acts of the General Assembly to referendum, and publishes them together with constitutional amendments to be voted upon in the general elections (Const., Art. XVI; Code Election Law Article, sec. 6-205).
Upon the presidential primary ballot, the Secretary may place the names of those candidates determined to be advocated generally or recognized in the media (Code Election Law Article, sec. 8-502).
♦️The correct and proper reading of EL Article Section 8-502(c)(2) is pretty simplistic and straight forward as the SOS is DIRECTED. There's NO "wide latitude" under the written law as the attached press story indicates. In context:
"(2) The Secretary of State shall certify the name of a presidential candidate on the ballot when the Secretary has determined, in the Secretary's sole discretion AND CONSISTENT WITH PARTY RULES,
👉🏽THAT THE CANDIDATE'S CANDIDACY IS GENERALLY ADVOCATED OR RECOGNIZED IN THE NEWS MEDIA THROUGHOUT THE UNITED STATES OR IN MARYLAND,👈🏼
unless the candidate executes and files with the Secretary of State an affidavit stating without qualification that the candidate is not and does not intend to become a candidate for the office in the Maryland primary election."
♦️ On reading the above (from the Maryland Constitution and State Election Law), somebody explain to me why they believe the SOS would be able to "not certify" Donald J. Trump as a candidate on the 2024 Primary ballot‼️
Should the SOS NOT meet her Constitutionally and legally required deadline of January 22, 2024 and timely transmit the official ballot to the State Board of Elections, then she should be charged/ prosecuted/impeached/removed from office.......
If the Maryland Republican Party (including their representatives) lack the "nads" then it will be left to the registered Republican voters to treat the Party accordingly‼️ #NewtonSaidIt
